ISLAMABAD: Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry on Friday took suo moto notice of the presidential order of elevation of Justice Khawaja Sharif Ahmed in Supreme Court of Pakistan and appointment of Justice Saqib Nisar as acting Chief Justice of Lahore High Court.
The CJ has constituted a three-member bench to hear the case proceeding of which is likely to be commenced shortly in the premises of Supreme Court of Pakistan. Justice Mian Shakirullah Jan will head the bench while Justice Raja Fayyaz Ahmed and Justice Jawad S. Khowaja will be the other members.
The President earlier on Friday appointed Justice Nisar as acting chief justice of LHC following the elevation of his predecessor Justice Khawaja Sharif Ahmed as judge Supreme Court of Pakistan.
The appointments were conflicted with what was recommended by the CJP Justice Chaudhry, who in his summary to the Presidency had reportedly recommended to elevate Justice Saqib Nisar to Supreme Court and to retain Justice Khawaja Sharif as CJ LHC.
The two judges have also refused to obey the order and assuming their new offices, terming it illegal. They were quoted in the media as saying that they will only follow the orders of Chief Justice of Pakistan.
